OTP: Anyone else receive a 'newsletter' from this idiot?

The following is long, and does not relate to arthritis. Some of you
however may have imput concerning the receipt of unsolicited emails from
the individual involved.

I have received several 'email newsletters' from this fool.  Now this
"Millions of Health Freedom Fighters - Newsletter". Purporting to be
'subscription' newsletters, and since I did not subscribe or otherwise
opt-in, I sent out complaints to the relevant isp's, and also to Bolen's
isp - earthlink/yahoo.

Anyone else find themselves signed up without their permission?

Why do I care? Look further down and you will see an email I have
received from Bolen. 

I DON'T CHOOSE TO BE THREATENED...If he thinks that I am in the least
intimidated, he has not done his homework.

He is the paid flack for several 'alt' health operations, and runs
several websites in their defense.  

Would you care to see the 'quality' of his client base? check at the
very bottom of this message.

In the meantime, since he lives and works in California, there is a law
out there that mass email MUST be labeled - he did not do so- and the
fine can be up to $10,000 per day in damages if it hit someone out
there...

I have already started by forwarding both the original and now the
'threat' to all appropriate authorities, and will gladly add any others
that may have been received by any of you here.

Check out the headers and see if you have received anything like it, my
response to his threat follows:

Here is his ludicrous and cartoon-like email in response to my
complaint:

Mr. Holland:

Let it make it clear to you that the attached communication, by
you, is legal evidence of YOU intending damage against my
business.  I am operating according to the laws of the State of
California.  You have filed a FALSE complaint against me.  You
have also defamed me with these agencies.

Unless you take action IMMEDIATELY to correct that situation YOU
WILL BE SUED in California.  Should any person or entity, because
of your communication cause me the least bit of effort - YOU will
be sued.

Make it easy for me, and send your address for legal service, by
return e-mail.  I will see that you get a certified letter
detailing my intent.

----- A PUBLIC RESPONSE TO SUCH NONSENSE -------

Here's what I think of your email:

You, your wife Jan, or your employee, added my addy to your
newsletter(s) db list - without my permission.

I exercised my legal right to complain to all appropriate parties and
demanded to be removed.

Your response did not address whether or not you have removed my addy as
required by California law.

Your response is factually untrue, and thus irrelevant except as it
violates the acceptable use policy of your personal isp earthlink/yahoo,
specifically:

>that is unlawful, harmful, threatening, abusive, harassing, tortious,
>defamatory, vulgar, obscene, libelous, invasive of another's privacy,
>hateful, or racially, ethnically or otherwise objectionable;

Therefor this latest missive from you has also been reported as abuse to
them.

As to any actions causing harm to your 'business' - I believe that the
record shows that you are doing a more than adequate job of that all on
your own. 

I neither care, nor want to know about, your 'business' affairs. 

And lest you believe that I am alone in thinking this about your
operation, you have only to run a google check for:

It would appear that you have a 2 1/2 year history of abuse.

Might I suggest that instead of spending your time issuing such
ludicrous 'rants' you should be properly supervising your 'business' so
as to preclude the need for complaints to be issued against you and your
email 'newsletter' operations.

Had you better occupied your time instead of trying to intimidate
people, perhaps you would not find yourself in the position of having
the record of Fed. IRS liens, State of California Tax Liens, and
property records posted about you on the internet.

These publicly posted messages would appear to be about you, Mr. Bolen:

As it is, the Federal Trade Commission has now filed charges against
your primary client, so I gather that you will be rather busy with
that...Here is the 'latest' article on that client:

This is the same entity that you 'tout' in the newsletter you spammed me
with...truly bad timing on your part.

So, Mr. Bolen, I repeat - TAKE ME OFF YOUR DAMNED NEWSLETTER LIST(S),
you know, the ones I never signed up for...(Nor did I even bother to
read them.) 

I would also like to point out to you that your site is registered
through GoDaddy, and they have a fine record of pulling the records of
abusers...

If you really what me to come to California,  - I suggest that you look
up current law, specifically recent case decisions on Joey McNichol. .

What did Joey do, you ask? He complained about receiving unsolicited
emails. And just like you, the spammer wanted to claim interference with
his business. The courts decided in Joey's favor...The spammer that
tried to sue him lost, and is paying all Joey's costs to defend himself. 

As to process service - I think it appropriate for you to bear that cost
also.

Given California law, do you feel lucky?

You have presented yourself in other forums as a "PR" specialist. From
this episode I can only surmise that it stands for "Pretty Ridiculous".


Finally, you might be wondering why I have posted this here. Well, Mr.
Bolen, I don't like it when someone tries to be a bully. Given your
email and it's tone, I think a public forum is most appropriate...

Your attempt to threaten me is patently absurd.

You may rectify this by publicly apologizing and confirming that I am
removed from your list(s) and that you will personally ensure that I
remain off of them.
